What is Conveyancing?

Conveyancing is the process of when the title of property is transferred from one person to another. It generally consists of three steps:

1. Pre Contract;

2. Pre Completion;

3 .Post Completion.

Conveyancing begins when you first enter into the contract, you may engage a lawyer to review and advise on the contract prior to signing. The conveyancing process ends once the transfer of title is registered at the Land Titles Office.  This means ownership of the property has been transferred from the vendor (Seller) to the purchaser (Buyer).  

The conveyancing process is complicated and there is a high risk for error.  If a mistake is made along the way, the results can be extremely costly, that is why it is important to engage a property lawyer to ensure your property is protected.

What is the difference between a lawyer and a conveyancer

A lawyer is a qualified legal practitioner who can give legal advice on all aspects of a conveyance transaction.  A conveyancer cannot give legal advice and can only follow the procedure of the conveyancing transaction. In the event of any legal issues arising from a conveyance transaction, a conveyancer would need to refer you to a lawyer, which will mean additional costs.
